使用條款

1. 含義

「適用法律」有關任何人仕，行動或物品指：

(a) 任何於香港或其他國家（或國家之政治分區）而又適用於其中一方之法律，法例或規條；

(b) CSL於香港或其他國家（或國家之政治分區）持有之牌照下所需履行之任何責任；

(c) 任何於香港或其他國家（或國家之政治分區）而又適用於其中一方之合法的裁決、決定、指令、指引、聲明或工作守則； 或

(d)  任何適用之國際公約或協議。

「CSL」指香港流動通訊有限公司。

「freeBlog」是一個網上服務，讓用戶以文字、圖像或影片形式於freeBlog互聯網網站及WAP網站（「 freeBlog 網站」）發表思想、分享內容及與其他用戶或外來使用者自由互動（「本服務」）。freeBlog 用戶可以選用「 Ring 」 服務,，直接以短訊與其他用戶建立更緊密聯繫。所有透過 Ring 發表之內容均同時於 freeBlog 網站更新。

「使用者」指：

a) 任何瀏覽freeBlog網站人仕；

b) freeBlog登記用戶而非CSL 之客戶；

c) freeBlog登記用戶並屬於CSL之客戶；

d) 任何向本服務提供影音內容、資訊、其他資料或服務之人仕；或

e) 任何使用Ring 之用戶。

未成年人士（18歲以下人士）必須先獲得家長或合法監護人同意方可使用本服務。登記本服務，閣下須保證提供作登記之資料為真確。如發現資料有誤，CSL有權取消閣下之使用資格而不作事前通知。

除特別註明外，任何於本使用條款未有額外詮釋之詞彙，已於流動電話及購買手機協議(「服務協議」)之條款及細則中詮釋及本使用條款適用於所有使用者。

2. 責任

2.1　CSL同意提供而閣下同意使用本服務並接納本使用條款及CSL個人資料私隱的政策。詳情可參閱 http://www.hkcsl.com/inside/privacy/index_c.html　

2.2   閣下明白及同意CSL有權對使用條款及個人資料私隱的政策作定期更新而毋須事前通知。閣下使用或進入本服務，即表示閣下已接納最新版本之使用條款及個人資料私隱的政策。閣下有責任定期參閱有關資料。

2.3  在所有情況下，閣下均有責任備份閣下的記錄。

2.4  如閣下不同意本使用條款的任何一項，請不要使用本服務。

2.5   以下條款適用於非CSL 登記客戶之使用者 (「外來使用者」)

外來使用者確認根據CSL的明確授權，只獲准觀看本服務所載的內容。外來使用者不可在未有得到CSL明確授權的情況下影印、複製、分發、傳送、廣播、展示、出售、發出許可或以有關內容製造任何衍生物資，或透過本服務上載任何內容。

3. 許可使用及受禁行為

3.1 閣下須同意：

(i) 受適用法律之約束及遵守本使用條款及 CSL個人資料私隱的政策；及

(ii) 使用本服務作個人、非商業用途

（「許可使用」）方可使用本服務。

3.2 CSL保留所有權利隨時刪除於freeBlog網站的任何或所有閣下的發表內容，而毋須事前通知或得到閣下的同意。

3.3    閣下亦同意不會上載, 張貼, 傳送, 散播或以其他方式提交任何︰

(i) 非法，有害，恐嚇，侮辱，騷擾，侵權，粗鄙，侵犯他人私隱，憎恨，冒犯種族或民族或其他厭惡性，或鼓勵歧視性行為及被視為可構成刑事罪行之內容；

(ii) 受商業秘密或其他第三者所有權權利之內容，包括私隱及宣傳權利，除非閣下是有關權利的擁有人或已得到合法擁有人的准許發表有關資料及內容，並授權CSL使用所有有關的許可；

(iii) 不雅，淫褻或色情之內容；

(iv) 含有病毒，木馬病毒，任何引致電腦軟件、硬件、電訊設備受到破壞、毀壞之電腦程式或電腦代碼之內容；及

(v) 違反適用法律及引致刑事及民事訴訟之內容。

3.4    閣下同意不會於使用本服務時:

(i) 發行可引致 CSL或任何第三者受損害的虛假、失實或譭謗陳述；

(ii) 發表廣告；

(iii) 招攬生意；

(iv) 冒充他人；

(v)  使用任何方法收集用戶名稱，電郵地址，電話號碼以發送未經許可之電子信息。

3.5  閣下同意為所有於使用本服務之行為, 包括上載檔案及發表意見負責。

4.   知識產權

 4.1          經閣下指示透過本服務發表的任何影片、圖像、聲音片段、文字或其他提的交資料（「發表內容」）即成為已發行的內容而並不會被視為可以識別個人的資料。閣下須獨自為發表內容及發表或發行有關內容承擔所有後果。

4.2 閣下確認、表示及/或保證︰

(i) 閣下擁有或持有任何及所有發表內容所須的許可、權利、同意、允許並授權CSL使用所有閣下的發表內容的專利、商標、商業秘密、版權或其他所有權權利，讓發表內容可以根據本服務及本使用條款被使用及包括於本服務內；及

(ii) 閣下持有發表內容內所有及每個可以識別的個人之書面同意、豁免及/或准許，使用所有及每個可以識別的個人之名字或畫像，讓發表內容可以根據本服務及本使用條款被使用及包括於本服務內。

4.3   CSL的知識產權

閣下清楚知道CSL及CSL供應商擁有本服務之所有知識產權，包括所有使用權及權益。

4.4 閣下的知識產權

CSL 對閣下於本服務或透過本服務所提交、張貼或顯示的發表內容不會申索任何擁有或控制權。閣下或第三方授權者可視乎適用而定保留於本服務或透過本服務之任何提交、張貼或顯示 的發表內容之所有專利、註冊商標及版權，而閣下負責視乎適用而定保護其權利。 一旦在透過公開給社會大眾的 本服務送出、張貼或顯示發表內容，即表示閣下給予 CSL 全球性的非專用、無專利權費的許可，同意 CSL 可基於展示及散佈本服務等原因，重製及發佈在 freeBlog網站、短訊及freeBlog Ring服務上的發表內容。 CSL同時也依其完全酌情權，保留拒絕接受、張貼、顯示或傳輸「內容」的權利。

5.   聲明

5.1 本服務可能載有連結至第三者的網站而這些網站並不是由CSL擁有或控制。CSL對任何第三者網站的內容、私隱政策或慣例，並無控制權亦不會負上任何責任。此外，CSL並不會亦不能夠審查或校訂任何第三者網站的內容。閣下如使用本服務，即表示閣下明確免除CSL就使用第三者網站的任何及所有責任。因此，CSL鼓勵閣下於離開本服務時多加留意，並閱讀每個閣下所瀏覽的網站的條款及細則以及私隱政策。

5.2   CSL不保證以下事項：

(i) 本服務符合閣下的要求；

(ii) 本服務不受干擾、及時提供、安全可靠或免於出錯；

(iii) 使用本服務而取得之結果為正確或可靠的；

(iv) 閣下經由本服務取得之任何服務、資訊或其他資料將符合閣下的期望。

5.3 閣下明確了解及同意，使用本服務之風險由閣下個人負擔，本服務是依「現況」及「現有」基礎提供，CSL表明不提供任何明示或默示的擔保，包括但不限於商業適售性、特定目的之適用性及未侵害第三方的權利。任何使用者之通訊或個人化設定之時效、刪除、傳遞錯誤、未予儲存或因任何資料之下載而導致閣下流動電話設備之任何損壞或資料流失，或由任何第三者透過本服務傳送或傳送至本服務的任何錯誤、病毒、木馬病毒或類似物件，CSL均不予負責。

6. 彌償

閣下同意彌償 CSL 及其附屬公司、聯繫公司、人員、代理人及員工就基於閣下不當使用本服務、違反本使用條款或第三方的權利而引致的任何第三方提出之申訴或要求。閣下亦同意保証 不致 CSL 遭受因閣下不當使用本服務、違反本使用條款或第三方的權利而引致的損害。

7.   終止；暫停

7.1   CSL保留於有或没有事前通知的情況下隨時暫停、終止或停止本服務的權利、而毋須承擔任何法律責任。 CSL亦保留拒絕提供本服務予任何人的權利、而毋須事前通知或作出任何解釋。

8.   雜項

此條款不適用於外來使用者。

8.1 除此使用條款外, 閣下必須遵守服務協議的條款及細則。

8.2 如本使用條款與服務協議的條款及細則不附, 本使用條款將為最後依據。

9. 詮釋

9.1   此使用條款將按香港法律條例詮釋。 如有任何爭議，雙方同意遵從香港法律的獨有裁判權。

9.2 如有任何爭議, 一切以英文釋本為準。

Terms of Use

1.      Definition:

“Applicable Law” in relation to any person, action or thing means:

(a) any law, rule or regulation of Hong Kong or any country (or political subdivision of the country) which is applicable to a party;

(b) any obligation under any licence held by CSL in Hong Kong or any country (or political subdivision of the country);

(c) any lawful determination, decision, direction, guideline, statement or code of practice in Hong Kong or any country (or political subdivision of the country) which is applicable to a party; or

(d) any applicable international convention or agreement.

“CSL” means Hong Kong CSL Limited.

"freeBlog" is an online publishing service ("Service") which allows Users to post thoughts, share contents in text, images and video format and interact freely with other Users via  the freeBlog Internet website and freeBlog WAP site (“freeBlog site”). freeBloggers can subscribe the “Ring” Service to communicate via short messages to build a closer network with friends and other freeBloggers. All communications of “Ring” will be displayed on the freeBlog Site.

 “User” means:

(a)     a visitor browsing the freeBlog Site;

(b)     a user who has registered as a freeBlogger but is not a registered customer of CSL;

(c)     a user who is a registered customer of CSL who has also registered as a freeBlogger;

(d)     a user who is a contributor of audio and video content, information, and other materials or services to the Service; or

(e)     a user who is using freeBlog “Ring”  Service.

Any minor (age 18 or below) must first obtain parental or guardian permission before using the Service. CSL reserves the right to refuse providing the Service to you at any time without prior notice if the information provided by you is found to be inaccurate.

Unless otherwise stated, terms defined in the CSL’s Mobile Radio Telephone Service and Handset Purchase Agreement (“MRTSA”) shall have the same meanings when used in these Terms of Use.

2.      Obligations

2.1    CSL agrees to supply the Service to you and you agree to use the Service subject to these Terms of Use and CSL’s Privacy Policy (a copy can be found in http://www.hkcsl.com/inside/privacy/index.html

2.2    You understand and agree CSL has the sole right to modify these Terms of Use and CSL’s Privacy Policy at any time without notice. You further agree that your use of and access to the Service will be subject to the latest version of the Terms of Use and CSL’s Privacy Policy. Hence, it is your responsibility to ensure that you review these Terms of Use and CSL’s Privacy Policy regularly. Your use of and access to the Service constitutes your acceptance of the latest version of the Terms of Use and CSL’s Privacy Policy.

2.3    You are responsible for the back-up your own records in all circumstances.

2.4    If you do not agree to any of these Terms of Use, then please do not use the Service.

2.5    The following term applies to User who is not a registered customer of CSL ("External User"):

The External User acknowledges that he/she is only permitted to view the content contained in the Service as expressly authorised by CSL. The External User may not copy, reproduce, distribute, transmit, broadcast, display, sell, license or otherwise create derivative works from the content, or upload any content through the Service without expressly being authorised to do so by CSL.

3.      Permitted Use and Prohibited Act

3.1    You are only permitted to use the Service if:

(a)   you agree to be bound by the Applicable Law, these Terms of Use and CSL’s Privacy Policy; and

(b)   you use the Service solely for your own, personal, non-commercial use and enjoyment

(“Permitted Use”).

3.2    CSL reserves the rights to remove all or any of your Submissions at any time without any prior written notice and/or without your consent.

3.3    You further agree not to use the Service to upload, post, transmit, distribute or otherwise make available any content that:

(i)      is unlawful, harmful, threatening, abusive, harassing, tortious, vulgar, invasive of another’s privacy, hateful, or racially, ethnically or otherwise offensive or encourages conduct that would be considered a criminal offence;

(ii)     is protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the originator or the owner or you have been granted a right by the originator or the owner of such materials or contents;

(iii)    is indecent, obscene or pornographic;

(iv) contains computer viruses, Trojan horses and any computer programmes or codes that have functions or ability to damage, destroy or limit the functionality of any other computer software, hardware and telecommunications equipment and the telecommunications and information system; and

(v) violates any Applicable Law or give rise to any criminal or civil liability.

3.4    You also agree not to:

(i)      publish falsehoods, misrepresentations, libelous or defamatory statements that could damage CSL or any third party;

(ii)     post any advertisements;

(iii)    solicit business;

         (iv)    impersonate another person; and

(v) collect usernames, email addresses and / or telephone numbers of other Users by electronic or other means for the purpose of sending unsolicited electronic messages

when using the Service.

3.5    You agree that you are liable for your use, any actions or omissions to act arising from or in connection with the use of the Service including any publications you make and any files you upload.

3.6    Given the nature of the Internet, you further agree to comply with any laws and regulations regarding online conduct and posting of sensitive materials and contents in the country in which you reside.

4.      Intellectual Property

4.1    Any video, image, audio clip, text or other content posted at the direction of the User ("Submissions") through the Service becomes published content and is not considered personally identifiable information. You will be solely responsible for your own Submissions and the consequences of posting or publishing them.

4.2    You affirm, represent, and/or warrant that:

(i)    you own or has the necessary licenses, rights, consents, and permissions to use and authorise CSL to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Submissions to enable inclusion and use of the Submissions in the manner contemplated by the Service and these Terms of Use; and

(ii)   you have the written consent, release, and/or permission of each and every identifiable individual person in the Submissions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the Submissions in the manner contemplated by the Service and these Terms of Use.

4.3    CSL’s Intellectual Property Rights

You acknowledge that CSL and CSL’s suppliers own right, title and interest in and to the Service, including all intellectual property rights.

4.4    Your Intellectual Property Right

CSL claims no ownership or control over any Submissions submitted, posted or displayed by you on or through the Service. You or a third party licensor, as appropriate, retain all patent, trademark and copyright to any Submissions you submit, post or display on or through the Services and you are responsible for protecting those rights, as appropriate. By submitting, posting or displaying any Submissions on or through the Services which are intended to be available to the members of the public, you grant CSL a worldwide, non-exclusive, royalty-free license to reproduce, publish and distribute such Submissions on the freeBlog Site and via short messages service or freeBlog “Ring” service for the purpose of displaying and distributing the Submissions. CSL furthermore reserves the right to refuse to accept, post, display or transmit any Submissions in its sole discretion.

5.      Disclaimer

5.1    The Service may contain links to third party websites that are not owned or controlled by CSL. CSL has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, CSL will not and cannot censor or edit the content of any third-party site. By using the Service, you expressly relieve CSL from any and all liability arising from the use of any third-party website. Accordingly, CSL encourages you to be aware when you leave the Service and to read the terms and conditions and privacy policy of each other website that you visit.

5.2    CSL makes no warranty that:

(i)    the Service will meet your requirements;

(ii)   the Service will be uninterrupted, timely, secure or error-free;

(iii) the results that may be obtained from the use of the Service will be accurate or reliable;

(iv) the quality of any services, information or other material obtained by you through the Service will meet your expectation.

5.3    You expressly understand and agree that your use of the Service is at your sole risk, and the Service is provided on an "AS-IS" and "AS AVAILABLE" basis and that CSL expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to merchantability, fitness for a particular purpose and non-infringement. CSL assumes no responsibility for the timeliness, deletion, mis-delivery, failure to store any User communications or personalisation settings, or for any damage to your Mobile Equipment or loss of data that results from the download of any such material, or for any bugs, viruses, Trojan horses or the like which may be transmitted to or through the Service by any third party.

6.      Indemnity

6.1    You agree to indemnify and hold CSL and its subsidiaries, affiliates, officers, agents and employees harmless from any claim or demand including legal fees made by any third party due to or arising out of your use of the Service, your violation of these Terms of Use or your violation of any rights of another.

7.      Termination and Suspension

7.1     CSL reserves the right to suspend, terminate or discontinue the Service with or without notice at any time and without any liability to you and the right to refuse service to anyone at any time without notice for any reason.

8. Miscellaneous

This clause does not apply to an External User.

8.1   In addition to the terms and conditions contained in these Terms of Use, you agree to be bound by the terms and conditions of the MRTSA.

8.2   To the extent that a specific term or condition set out in these Terms of Use is inconsistent with the MRTSA, the provisions set out in these Terms of Use shall prevail.

9      Interpretation

9.1   The validity and interpretation of these Terms of Use shall be governed by the laws of Hong Kong and all parties shall submit to the exclusive jurisdiction of the courts of Hong Kong in the event of dispute.

9.2   To the extent that any provisions of the English version Terms of Use is inconsistent with the Chinese version Terms of Use, the English version Terms of Use shall prevail.
